2 Insolvent Estates: A Challenge for Queensland Families The administration of a deceased estate is often a difficult responsibility, particularly where grief is accompanied by financial complexity. A significant issue arising for Queensland executors and families is the discovery that an estate may not have enough assets to meet its debts. An estate is insolvent when the deceased person’s liabilities are greater than the assets available to pay them. This may involve unpaid loans, credit cards, tax debts, business liabilities, or other creditor claims exceeding the value of bank funds, property, vehicles or personal possessions. For executors and administrators, this situation requires careful handling. Their role is not simply to distribute assets to beneficiaries. They must first establish the estate’s financial position, identify creditors, preserve assets, and ensure debts are dealt with in the correct order. If distributions are made too early, an executor may be exposed to personal liability. Beneficiaries should also be aware that an entitlement under a will does not take priority over lawful creditor claims. Where an estate is insolvent, creditors and administration expenses must be addressed before any beneficiary receives a distribution. In some cases, there may be nothing left to distribute. More complex insolvent estates may require formal administration under the Bankruptcy Act 1966 (Cth), including the appointment of a registered trustee. This can provide an independent process for investigating assets, managing creditor claims and distributing available funds. Australian Red Cross Lifeblood says recent appeals have prevented supplies falling to critical levels but have not been enough to replenish low supplies of O-positive and O-negative blood types, which are the types used in emergencies. A-positive blood stocks have also dropped in recent weeks. Around 8,000 units of blood, plasma and platelets are issued nationally as urgent or life-threatening orders every month, meaning they must be dispatched within as little as 30 minutes to support patients in critical situations. At the same time, winter illness is hindering donations. A new Lifeblood survey found almost 40 per cent of Australians have recently experienced cold, flu or respiratory illness symptoms. Lifeblood spokesperson Belinda Smetioukh said this wipes out potentially thousands of people from donating, as blood donors need to be seven days clear of symptoms before they can donate. “Nationally we’re seeing up to 1,600 donation appointments sit empty every day, with many more people cancelling or rescheduling appointments,” Belinda said. “Even mild symptoms such as sniffles, sore throats, and headaches make people temporarily ineligible to give blood, and this can severely impact the availability of donors during winter months. “Only three per cent of Australians donate blood. We’re asking people not to leave it to others — our regular donors alone cannot sustain supplies through winter, and we need more people to step up.” Belinda said O-negative and O-positive blood are particularly important because they are often used in emergencies when a patient’s blood type is unknown. “Patients in critical situations will always get the blood they need, but full fridges are essential to ensuring blood is available for everyone who needs it, when they need it,” she said. “This includes cancer patients, new mothers, people undergoing surgery, and many other patients, including children who need donated blood to save their lives.” Belinda urged people who don’t know their blood type to donate, with more than 80 per cent of Australians having an O or A blood type. Originally formed by Jeff Goode we have been running for close to three decades at various locations on the coast. For the past fifteen years or so we have found an idyllic location at the Southport Library in Lawson Street, Southport. We meet on the third Sunday of each month between 1:15 pm and 3:15 pm. Generally, we have enough time to read three poems each. It is caused by the hardening of the lens inside the eye, causing a gradual loss of vision. Most cataracts develop as part of the ageing process. Cataracts tend to affect people aged over 65, but the age of onset can vary. Some people aren’t affected until well into their 70s, while some develop cataracts at an earlier age. In fact, by the age of 80 most of us will have some degree of cataract formation. Other risk factors include long-term exposure to sunlight, smoking, diabetes and family history. Clouded, blurred or dim vision are the most common symptoms of cataracts. Many people don’t notice any changes early on, but as the cataracts progress they start to experience vision problems. Often people describe the quality of their vision as like looking through a dirty window. One of the other common signs is a sensitivity to glare, especially on a bright sunny day or when driving at night on artificially lit roads. Frequent years. A change to your spectacle prescription may help to keep cataract symptoms at bay for a time. However, for the best results the removal of cataracts through a surgical procedure is often recommended. The surgical procedure is straightforward and is usually performed under a local anaesthetic. In the absence of any other eye conditions the resulting vision is significantly improved in most cases. There is not much you can do to stop the formation of cataracts. Regular eye examinations with your optometrist, especially for those over the age of 65, can help to identify any changes as early as possible.
