2 Commercial Lease Expiring? Don’t Miss Your Option to Renew For many business owners, a commercial lease is a significant long-term commitment. But when a lease approaches expiry, tenants can sometimes overlook one of the most important provisions in their lease, the option to renew. An option may give a tenant the right to continue occupying the premises for a further period. However, it generally does not happen automatically. Tenants must carefully follow the requirements in their lease. Deadline Your lease will usually specify when the option must be exercised. Missing the deadline may mean losing the right to renew. Notice The lease may require written notice in a particular form or manner. Simply telling your landlord you want to stay may not be sufficient. Conditions The right to exercise an option may be subject to conditions, including compliance with your obligations under the existing lease. New rent The renewed term may involve a rent review or other change to the rent which should be considered before exercising the option.
